Jeevani Wickramaratna, previously falsely convicted of harassment, has had the judgement overturned and quashed by the Taunton Crown Court on Appeal as a "serious miscarriage of justice" and "an error of law".
She had been falsely accused and convicted of harassment because she was previously too traumatized by the assault and declined to give a witness statement about the events. The sentence was put on hold pending appeal and quashed on appeal, stating: "Communications saying stop to sexual harassment and attempted sexual assault is not harassment of the sex abusers."
Ms. Wickramaratna was represented by the respected barrister, Patrick Mason Q.C., of Octagon Chambers.
"There has been a grievous miscarriage of justice here. Jeevani was the victim and her Muslim abusers were yet able to corrupt their way into victimising her further in their fanatical rage of her rejection by trying to turn the tables on her because she simply said 'stop' to the assault, reported the Muslim men to the police, and commenced civil proceedings to protect herself,' her solicitor stated.
"There had been false rumours and reports that she was a 'Cougar' when the youngest of the 3 men involved was 6 years older than her, and the two Muslim men were over 7 years and 20 years older than Jeevani, indicating the allegations against her were entirely false and malicious. We were able to show that the youngest of the people involved here was 6 years older than her and that someone else had made up and sent the 'cougar' messages to ensure the breakup of the relationship. This is easily provable if you search the public director's reports on the names of the men; their ages are reported in the public domain showing them all to be much older than Jeevani," he said.
"Furthermore, there have been reports in error that Jeevani was previously convicted of 'sexual' harassment and she was 'preying' on her sex abusers. This is also false because there was never a 'sexual' element to allegations against her. Sexual assault was what she was subject to by the Muslim men and which she reported. This can easily be checked by contacting the courts. Which part of 'no' and 'stop' could these Muslim fanatics not understand? All of the emails were telling them to 'stop' all non-work contact with herself. The Muslim sex abusers were the ones preying on her."
"There is no excuse for not fact checking their reports by these reporters and no amount of the large compensation she is entitled to will atone for the trauma and the terror she has had to suffer at the hands of her Muslim abusers. Not only did the law let her down, but it turned on the victim. We are thankful for the superior knowledge of the Crown Court judges that has now allowed her some reprieve from the terror she has been subject to. This is not Iran. Jeevani does not have to take it quietly when two Muslim men sexually harass and try to sexually assault her!"
We have fact checked the above and found the men (the youngest man, the next youngest man, Kassem Benzair of Wimax Communications) were indeed much older than Jeevani, as confirmed by their records linked above; the third man, Pir Mohammed Khan, was his late sixties (as confirmed by his white pages record in Finchley). We have also confirmed with the court records that sexual harassment was Jeevani Wickramaratna's complaint; there was no 'sexual' element to the charges against her.
All of Jeevani's emails filed were telling them to stop sexual harassment and all sexual or personal contact with her forthwith. The men had tried to argue that her emails asking them to stop sex abuse was harassment of themselves, the sex abusers; that they had the right to sexually harass or abuse her without her telling them to stop!
"It was a disgusting nightmare," Ms. Wickramaratna commented. "I am Sinhalese Buddhist. In my culture such grotesque old Muslim men like them are considered low cast untouchables. We never have any non-business contact with them. I just wanted their revolting pursuit to stop."
A case is in the High Court for compensation from the assault she suffered and for violation of her Human Rights from the serious legal error.
